Palazzo San Vito - Rental Agreement: Terms and Conditions
This Rental Agreement ("Agreement") is made and entered into by and between:
Palazzo San Vito, operating under the legal name of Eudemor SRL, with its principal place of business at Via Cicolella 8/b, 73100 Lecce (LE), Italy ("Lessor"), and
The individual or entity booking a stay at Palazzo San Vito ("Lessee").
WHEREAS, the Lessor is the owner of the Palazzo San Vito property;
WHEREAS, the Lessee desires to rent the Palazzo San Vito property;
NOW, THEREFORE, in consideration of the mutual covenants and agreements contained herein, the parties agree as follows:
1. Booking and Confirmation:
a. Inquiry and Acceptance: Making an inquiry implies acceptance of these terms and conditions and constitutes an offer to enter into a rental agreement.
b. Confirmation Payment: A non-refundable confirmation payment of 50% of the total rental amount is due upon booking. This confirms the Lessee's intent to enter into a binding agreement.
c. Final Payment: The remaining 50% of the total rental amount is due 30 days before the arrival date. This payment is non-refundable.
d. Contract Formation: The contract is formed when the Lessor receives the full payment. The Lessor reserves the right to cancel the reservation if the confirmation payment is not received within 5 banking days of booking.
e. Payment Methods: Payments can be made via wire transfer or credit card. Additional fees, where legally permissible, may apply to credit card payments. This will be clearly communicated to the Lessee before payment.
2. Arrival and Departure:
a. Check-in: 4:00 PM.
b. Check-out: 10:00 AM.
c. Early/Late Arrangements: Early arrival or late departure is subject to availability and may incur additional fees. Any such fees will be communicated clearly in advance.
3. Occupancy:
a. Authorized Guests: Only the number of guests specified at the time of booking are permitted on the premises.
b. Guest Registration: All guests must be registered with valid identification (passport, driver's license, or ID card) in compliance with Italian Police regulations and data protection laws (GDPR).
4. Minimum Stay:
a. A minimum stay of 3 days is required.
5. Security Deposit:
a. Deposit Amount: A security deposit of 1000 EUR is required 7 days prior to arrival.
b. Deposit Method: The security deposit can be secured via a credit card pre-authorization (hold) or bank transfer.
c. Deposit Return: The security deposit will be released (in the case of a pre-authorization) or returned (in the case of a bank transfer) within 7 days of checkout, provided no damages or breakages have occurred.
d. Damage Liability: The Lessee is liable for any damages or breakages exceeding the security deposit amount. The Lessor will provide a detailed breakdown of any damages and costs.
6. Cancellation Policy:
a. Cancellations 60 or more days prior to arrival: 50% of the total rental amount is forfeited (non-refundable confirmation payment).
b. Cancellations 60 or fewer days prior to arrival: 100% of the total rental amount is forfeited (no refunds).
7. Reservation Changes:
a. Date Changes: Changes to reservation dates after confirmation are treated as a cancellation and rebooking and are subject to the cancellation policy.
8. Guest Insurance:
a. Requirement: The Lessee and all guests are strongly recommended to maintain comprehensive travel insurance, including coverage for cancellation, loss/damage to baggage, flight delays, and health coverage (including evacuation and repatriation).
b. Lessor's Liability: The Lessor's liability is limited to the rental of the property. The Lessor is not liable for any accidents or third-party services.
9. Force Majeure:
a. The Lessor is not responsible for events beyond their reasonable control, including but not limited to fires, floods, civil disturbances, severe weather, and Acts of God.
10. Complaints:
a. Initial Contact: Issues should first be addressed with the on-site property manager or staff.
b. Formal Complaint: If the issue remains unresolved, the Lessee must contact the Lessor via email (ciao@palazzosanvito.it).
c. Written Complaint: Any complaints must be submitted in writing to the Lessor within 24 hours of the issue's occurrence.
11. Conduct and Behavior:
a. Lessee Responsibility: The Lessee is responsible for the behavior of all guests.
b. Inappropriate Behavior: Inappropriate behavior may result in the Lessee and their guests being asked to vacate the premises without a refund.
c. Lessor's Access: The Lessor's representatives reserve the right to enter the premises for necessary repairs or maintenance, giving reasonable notice where possible, except in emergencies.
12. Specific Conditions:
a. Pets: Small dogs are permitted only with prior approval and upon payment of a 150 EUR fee.
b. Smoking: Smoking is strictly prohibited inside the property.
c. Noise: Noise levels must be kept to a minimum, especially between 11 PM and 7 AM, in accordance with local regulations.
d. Breakfast Basket: Available if ordered by 6 PM the day prior, payable in cash to the housekeeper.
e. Linens/Towels: Provided and remain the Lessor's property. Beach bags and towels are also provided for off-premises use but remain the Lessor's property.
f. Trash: Strict trash disposal and recycling regulations must be followed. Improper disposal will incur a 150 EUR fee.
13. Due Care, Supervision, and Indemnity:
a. Lessee Responsibility: The Lessee is responsible for the safety and well-being of all guests, including children.
b. Indemnification: The Lessee indemnifies and holds the Lessor harmless from any liability arising from accidents, injury, or loss of life, to the extent permitted by applicable law.
14. Valuables:
a. Storage: Valuables should be stored in the provided safety deposit box.
b. Lessor's Liability: The Lessor is not liable for lost or damaged items, to the extent permitted by applicable law.
15. Artwork:
a. Lessee Liability: The Lessee is responsible for any damage to artwork or antiques and will be liable for repair or replacement costs.
16. Jurisdiction and Governing Law:
a. Governing Law: This Agreement is governed by Italian law.
b. Dispute Resolution: Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the local courts of the property's location.
Entire Agreement: This document constitutes the entire agreement between the parties and supersedes all prior agreements and understandings, whether written or oral.
Severability: If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Amendments: Any amendments to this Agreement must be in writing and will be published on Palazzo San Vito website (www.palazzosanvito.it/terms)
